1. Warranty:

COMI Lighting limited (hereinafter referred to as "COMI"), warrants its products for 2~5 years or more (vary from different products) of its manufacture against defects in material and workmanship, subject to certain conditions and exclusions:

 

 

1.1 Warranty Terms & Conditions

 

This warranty is further conditioned upon proper storage, installation, use, operate and maintenance.

 

This warranty only applies to the first end-user purchaser or original purchaser and original installation of the products. This warranty is not transferable. During the warranty period, if a product covered by this warranty fails to confirm to this warranty and is returned by purchaser in accordance with COMI published warranty service declaration, COMI will, at its option, either repair or replace the product or the non-confirming part thereof, or reimburse the purchaser for the purchase price of the specific product. For purposes of clarity, "repair or replace the product or the non-confirming part thereof" does not include: (a) any removal or reinstallation cost or expenses, including without limitation labor costs or expenses , (b) Shipping fee and expense required to return product to COMI. If COMI chooses to replace the product and is not able to do because it has been discontinued or is not available, COMI may replace it with a comparable product.

 

All returns must be accompanied by a written statement setting forth customer's contact details, together with a brief description of any claim defects. And the parts or product for which replacement is made shall become the property of COMI. Unless otherwise agreed by the parties, the purchaser shall be responsible for returning costs of transportation and insurance and other fee from the purchaser to COMI, and COMI will return the repaired or replaced unit within thirty days and cover transportation and insurance cost from COMI to purchaser.

 

1.2 Exclusions

This warranty does NOT apply to:
(1) Any product not installed and operated in accordance with UL, NEC and with COMI instructions and guidelines for the product.
(2) Any incidental or consequential damages or failure to perform arising from abuse, misuse, abnormal stresses and operating conditions, alterations to the product that affects, electrical surges, or acts of God.
(3) Any product of another manufacturer that may have been used in conjunction with COMI product.
(4) Products used for purposes for which they are not designed or intended.
(5)Any product is agreed by the parties Not covered in warranty.


The above warranties also do not apply if:
-The original bill of sale, delivery date, or product number cannot be verified.
-The parts claimed to be defective are not returned for inspection if so requested by COMI.
-The product is not in the possession of the original end use purchaser.

The warranties and remedies set forth herein are exclusive and in lieu of all other warranties whether, express or implied, including all warranties or merchantability and fitness for a particular purpose and all warranties arising from course of dealing or usage or trade. Purchaser's exclusive remedy, and COMI sole liability, for any nonconformity or defect in any product shall be only those explicitly set for herein.

 

 

1.3 Limitation of liability

COMI will not under any circumstances whether as a result of breach of contract, breach of warranty, tort, strict liability or otherwise be liable for consequential, incidental, special or exemplary damages, including but not limited to, loss of profits or revenues, loss of use of the product or any other goods or associated equipment or damage to any associated equipment, cost of capital, cost of substitute products, facility of services, down time cost, or claims of claimant's customers. COMI liability on any claim of any kind for any loss or damage arising out of, resulting from or concerning any aspect of this warranty or from the product or services furnished hereunder shall not exceed the price of the specific product which gives rise to the claim.
